Under the Queensland Pool Safety Act 2010, all residential pools in Brisbane must have a current pool safety certificate when the property is sold or leased. Brisbane has hundreds of thousands of private swimming pools — and Queensland has among the highest pool ownership rates per capita in the world.
A pool safety certificate is issued only by a QBCC licensed pool safety inspector. The certificate confirms your pool barrier meets Australian Standard AS1926 and Queensland's specific requirements for fence height, gate hardware, non-climbable zones and signage.
When Do I Need a Pool Safety Certificate in Brisbane?
- Selling your property — required at settlement (or provide Form 36 disclosure)
- New tenancy agreement — must be provided to tenant before lease commencement
- Body corporate pools — shared pools require annual inspection
- Building a new pool — certificate required before the pool can be used
